MAYOR SMALL READ A PROCLAMATION, PROCLAIMING THE WEEK OF MARCH 8,

2009, AS GIRL SCOUT WEEK IN NEW CASTLE, INDIANA.

 

MAYOR SMALL WELCOMED SHELBY KISSICK, A STUDENT FROM CHRYSLER HIGH SCHOOL WHO SPENT THE DAY WITH THE EMS DIRECTOR RON BURNS, AT THE FIRST AID UNIT.  MISS KISSICK WAS WITH 20 OTHER STUDENTS WHO PARTICIPATED IN THE "MAYOR FOR A DAY" PROGRAM AND DECIDED TO ATTEND THE COUNCIL MEETING AS WELL AS THE BOARD OF WORKS MEETING THIS MORNING.

  

ORDINANCE #3565
AN ORDINANCE ESTABLISHING A CONSERVATION DISTRICT IN THE CITY OF NEW CASTLE WAS READ BY TITLE ONLY ON SECOND READING BY SANDY YORK.

      PRESIDENT YORK MOVED TO PASS THIS ORDINANCE.   COUNCIL LADY GOODMAN: SECOND

      DISCUSSION:  COUNCILMAN KIDD ASKED THAT THE ORDINANCE BE AMENDED.  HE SAID HE WAS NOT SATISFIED WITH PEOPLE THAT OWN HOMES MUST GO TO THE COMMITTEE TO GET PERMISSION TO DO SOMETHING.

      COUNCILMAN HAHN SAID IT WOULD BE AN AMENDMENT AND ASKED MR. DAVID NANTZ, TO EXPLAIN JUST WHAT DIRECTIONS CAN BE GIVEN TO PEOPLE ON WHAT THEY CAN DO AND CAN'T DO.

      MR. NANTZ SAID ALL THIS WOULD BE IS TEARING DOWN OR BUILDING.  OTHER CHANGES DO NOT HAVE TO BE REPORTED.  HE SAID WHAT THEY WERE DOING WAS TO KEEP SOMEONE FROM DEMOLISHING A HISTORICAL STRUCTURE.

      MAYOR SMALL SAID THE MAIN REASON HERE WAS TO PROTECT THE ADJOINING PROPERTY OWNER.  THIS PREVENTS THE NEIGHBOR FROM TEARING DOWN HIS HOME AND POSSIBLY PUTTING IN REPAIR PLACE OR A TATTOO PARLOR.  IT IS MAINLY FOR PROTECTION.

      CITY ATTORNEY COPENHAVER SAID WHEN THE COUNCIL PASSED ORDINANCE #3431 IT CREATED THIS AGENCY, THE HISTORICAL PRESERVATION COMMISSION.  THE COMMISSION HAS TAKEN THE DEFINITION AND THE PROVISIONS OF THAT ORDINANCE AND RECOMMENDED THE CREATION OF THIS DISTRICT.  THIS DISTRICT REQUIRES A CERTIFICATE OF APPROPRIATENESS TO DEMOLISH OR TEAR DOWN OR TO BUILD A STRUCTURE THERE.

      COUNCILMAN REID ASKED IF HE WANTED TO BUILD AN ADDITIONAL ROOM ON AND THE COMMISSION FELT THAT IT WAS NOT APPROPRIATE FOR THAT NEIGHBORHOOD, IT COULD BE DENIED.  HE SAID HIS OTHER QUESTION WAS, IF THE PROPERTY OWNER WANTED TO ERECT OR TEAR DOWN A GARAGE OR AN OUT STORAGE BUILDING, DO THEY ALSO NEED THE APPROVAL OF THE PRESERVATION COMMISSION?

      ATTORNEY COPENHAVER READ FROM ORDINANCE #3431, STATING THAT THIS IS A STATE ORDINANCE.  HE SAID THE ORDINANCE FOR THE CONSERVATION DISTRICT SAYS THAT A CERTIFICATE OF APPROPRIATENESS IS REQUIRED FOR THE FOLLOWING ACTIVITIES:  THE DEMOLISH OF ANY BUILDING, THE MOVING OF ANY BUILDING AND ANY NEW CONSTRUCTION OF A PRINCIPAL BUILDING OR ACCESSORY BUILDING OR A STRUCTURE  SUBJECT TO BE VIEWED FROM A PUBLIC WAY.  IF SOMETHING WAS GOING TO BE BUILT, THAT COULD NOT BE SEEN FROM BROAD STREET THAT WOULD NOT REQUIRE A CERTIFICATE OF APPROPRIATENESS.

IF IT COULD BE SEEN FROM BROAD STREET, THEY WOULD HAVE TO GO TO THE HISTORIC PRESERVATION COMMISSION AND GET A CERTIFICATE OF APPROPRIATENESS.  THAT IS WHAT YOUR FORMER ORDINANCE SAYS.  THIS IS A RECOMMENDATION FROM THAT COMMISSION SAYING THAT THIS ORDER SHOULD BE A CONSERVATION DISTRICT.

      COUNCILMAN REID ASKED IF A STRUCTURE COULD BE SEEN FROM A SIDE STREET OR REAR STREET THAT WOULD BE SUBJECT TO THAT.

      ATTORNEY COPENHAVER SAID HE THOUGHT THAT THE PUBLIC VIEW WOULD PERTAIN TO BROAD STREET.  IF YOU WERE TO TEAR DOWN AN OUT BUILDING BEHIND A HOUSE, THAT WOULD NOT REQUIRE ONE.  THE COMMISSION IS TO MAINTAIN THE HISTORIC NATURE OF A NEIGHBORHOOD.

      COUNCILMAN REID ASKED IF PROPERTY OWNERS WOULD RECEIVE NOTIFICATION.

      ATTORNEY COPENHAVER SAID YES. 

      NORMA DISHMAN SAID THE COMMISSION DOES A GOOD JOB BUT SHE THINKS TOO MUCH POWER IS GIVEN TO THEM.  SHE WANTS TO KNOW THE RULES AND REGULATIONS.

      COUNCILMAN REID SAID THAT BEFORE HE SAID NAY, HE SAID THE HISTORIC RESERVATION COMMISSION DOES A LOT OF GOOD.  HE SAID IT MADE SENSE TO HAVE A SMALL AREA OF A TOWN SET UP AND PROTECTED BY SUCH A COMMISSION, HOWEVER, HE THOUGHT ANYTHING OUTSIDE OF THAT SHOULD BE DONE ON A PROPERTY BY PROPERTY BASIS, NOT A BLANKET AREA.  HE SAID THAT REGARDLESS OF THE FINAL INTENT, HISTORICAL PRESERVATION GROUPS,

CAN PUT CONDITIONS ON PROPERTY THAT MAKES THEM LESS USABLE, LESS ATTRACTIVE TO POTENTIAL BUYERS.  AT THE END OF THE DAY, YOU ARE SELECTING A GROUP OF PEOPLE TO RENDER A JUDGMENT BASED ON, IN A LOT OF CASES NOTHING MORE THAN ESTHETICS OR OPINIONS.

ORDINANCE #3566
AN ORDINANCE OF THE CITY OF NEW CASTLE AUTHORIZING THE ISSUANCE OF GENERAL REVENUE BONDS FOR THE PURPOSE OF PROVIDING FUNDS TO PAY THE COST OF ROAD IMPROVEMENTS, FUNDING A DEBT SERVICE RESERVE FOR SAID BONDS, AND FUNDING THE PAYMENT OF A CITY DEBT, PROVIDING FOR THE SAFEGUARDING OF THE INTERESTS OF THE OWNERS OF SAID BONDS, OTHER MATTERS CONNECTED THEREWITH AND REPEALING ORDINANCES INCONSISTENT HEREWITH WAS READ BY TITLE ONLY ON SECOND READING BY SANDY YORK.

      PRESIDENT YORK MOVED TO PASS THIS ORDINANCE.  COUNCILMAN KOGER: SECOND

     DISCUSSION:  COUNCILMAN HAHN SAID HE WAS LOOKING AT THE LRS AND CCD FUNDS.  HE SAID OUR LRS WILL GO TO 5% THIS YEAR?

      CITY ACCOUNTANT CUPP SAID NO.  WE WILL HAVE FIVE CENTS ON CCD JUST THIS YEAR.  THEN IT WILL GO BACK TO LESS THAN ONE CENT PER YEAR.

      COUNCILMAN HAHN ASKED IF THIS RAINY DAY FUND WILL BE ALLOWED TO BE USED ON THE GARNER STREET BYPASS.

      COUNCILMAN KIDD ASKED JUST WHAT THE USES WERE FOR IN THE RAINY DAY FUND.

      ATTORNEY COPENHAVER SAID THAT THIS FUND IS REQUIRED BY THE STATE. THIS HAS TO GO INTO THE RAINY DAY FUND.  WHAT YOUR RAINY DAY FUND IS USED FOR PRIMARILY, TWO WAYS IT CAN COME INTO EFFECT.  ONE, PASS YOUR BUDGET AND LET'S SAY YOUR TAX REVENUES ARE NOT SUFFICIENT THAT COME IN DURING THE YEAR TO FUND YOUR BUDGET.  THIS COUNCIL MAY, BY RESOLUTION, TRANSFER MONEY FROM THE RAINY DAY FUND TO WHATEVER LINE OF THE BUDGET THAT YOU NEED TO TRANSFER MONEY IN, TO MAKE UP FOR PREVIOUSLY APPROPRIATED FUNDS.  THE OTHER SITUATION, LETS SAY WE HAD A FLOOD.  IT CAUSED DAMAGE TO THE CITY BUILDING.  WE NEED TO FIX THE BUILDING BUT DIDN'T HAVE THE MONEY.  IN THAT CASE, THE MONEY WOULD NEVER HAD BEEN APPROPRIATED.  IN THAT CASE YOU WOULD HAVE TO HAVE AN ADDITIONAL APPROPRIATION, BECAUSE THE MONEY HADN'T BEEN BUDGETED.  THE MONEY IS THERE FOR JUST WHAT IT SAYS.

      COUNCILMAN REID SAID THE ONLY THING HE COULD SEE WAS WHAT THE RAINY DAY FUND COULD BE USED FOR.  ACCORDING TO OUR ORDINANCE, AND ACCORDING TO I.C. 36-1-8-5.1, IS THAT A POLITICAL SUBDIVISION MAY ESTABLISH A RAINY DAY FUND BY THE ADOPTION OF AN ORDINANCE OF A COUNTY, CITY OR TOWN AND IT LISTS WHERE THE FUNDS CAN COME FROM.   IN SECTION B, AN ORDINANCE OR RESOLUTION ADOPTED UNDER THIS SECTION

MUST SPECIFY THE FOLLOWING PURPOSE OF THE RAINY DAY FUND AND THE SOURCE OF THE FUNDING WHICH BASICALLY INCLUDES EXCESS FROM 3 OR 4 DIFFERENT TAXABLE FUNDS UNDER 5.1 B 2A.  HE SAID AT THE BOTTOM OF THAT, AS SUBSECTION C, THE RAINY DAY FUND IS SUBJECT TO THE SAME APPROPRIATION AS OTHER FUNDS THAT RECEIVE TAX MONEY.  HE SAID HE COULDN'T SEE ANYTHING THERE THAT WE COULDN'T USE THAT FOR ANYTHING ELSE THAT WE CAN'T USE TAX MONEY FOR.

      ATTORNEY COPENHAVER SAID THAT WAS TRUE BUT IT IS A RAINY DAY FUND AND WAS ESTABLISHED TO HELP YOU AS A SAVINGS ACCOUNT WHEN THE BUDGET FALLS SHORT.  THAT IS THE PURPOSE.  IF YOU DECIDED THAT THIS ROAD WAS AN EMERGENCY, AND YOU HADN'T APPROPRIATED FOR IT, YOU COULD HAVE AN ADDITIONAL APPROPRIATION AND USE THIS MONEY FOR THAT.  HE SAID HE DIDN'T THINK THAT IS WHAT THE RAINY DAY IS FOR, A CAPITAL IMPROVEMENT.  ANYTHING YOU WANT TO USE THIS FOR WILL TAKE AN ADDITIONAL APPROPRIATION.  IT WAS DESIGNED FOR BUDGET SHORTFALLS.  JUST LIKE THE STATE'S RAINY DAY FUND, IT WAS ESTABLISHED TO DEAL WHEN THE STATE'S REVENUES ARE NOT AVAILABLE.

COUNCILMAN REID SAID THEN THERE IS NOTHING PROHIBITING US FROM USING THIS MONEY ON GARNER STREET.   ATTORNEY COPENHAVER SAID WHEN YOU FOLLOW THE RULES, YOU CAN DO IT.

      COUNCILMAN HAHN SAID HE WANTED TO AMEND THIS ORDINANCE TO READ $860,000.00.  HE SAID YOU TAKE $501,000.00 OUT OF THAT TO PAY THE GARNER STREET, THEN THAT WILL PAID OFF.  THAT WILL LEAVE US THE BALANCE OF THAT, PLUS THE $155,000.00 OUT OF THE LRS AND CCD, FOUR HUNDRED AND SOME THOUSAND DOLLARS, NOT INCLUDING ANY MONEY OUT OF THIS $293,000  FROM THE CEDIT, THE RAINY DAY FUND.  THEN IF WE CAN GET SOME MONEY, A HUNDRED OR SO OUT OF THAT, AND WE HAVE TWO YEARS TO GET THE EASTSIDE BYPASS, WHAT WE SAID AT THE LAST COUNCIL MEETING.

      COUNCILMAN HAHN GAVE A SUMMARY TO OTHER COUNCIL MEMBERS OF HOW HE CAME UP WITH HIS FIGURES.   HE SAID THE INITIAL AMOUNT WAS $860,000.00,  THEN $501,000.00 TO COMPLETE GARNER STREET.    TAKE THE $501,000.00 FROM THE $860,000.00, YOU COME UP WITH $359,000.00 TO WORK ON THE EASTSIDE BYPASS, PLUS TAKE MONEY FROM THE LRS, THE 5 CENTS THIS YEAR , AND ANY MONEY WE CAN FROM CCD, OR FROM EITHER  FUND, THEN ALSO, IT WAS STATED EARLIER, IF YOU FOLLOW THE NORMAL CHANNELS, THEN ANYTHING YOU WANT TO USE THIS FOR, THIS $293,386.00, TAKE SOME OF THAT, THEN YOU WOULD HAVE THE INITIAL AMOUNT TO START THAT AND STILL HAVE 2 YEARS TO OBTAIN MORE MONEY IF NEED BE.  IF NOT, YOU WOULD HAVE A START.  PAY AS YOU GO.  HE SAID THIS WAS HIS THOUGHT.

      PRESIDENT YORK ASKED LISA LEE, BOND ATTORNEY WITH ICE MILLER, IF THE 1.7 MILLION DOLLARS IS THE MAX.  THE 7 MILLION IS WHAT WE ARE GOING TO DO, RIGHT?  THAT IS THE MOST WE ARE GOING TO ASK FOR IF WE HAD TOO. 

      MS. LEE SAID YES.

      PRESIDENT YORK SAID WE MIGHT NOT HAVE TO ASK FOR THAT, RIGHT.

      MS. LEE SAID CORRECT.  SHE SAID SHE WOULD CAUTION, IT SOUNDS LIKE ABOUT LOWERING THIS TO SHOW WE CAN ONLY DO GARNER STREET AT THIS TIME.  THAT IS COUNCIL'S DECISION.  NOT ONLY DO YOU HAVE THE $501,000.00 CONSTRUCTION COSTS, YOU ALSO HAVE THE DEBT SERVICE RESERVE AND YOU HAVE COST ADDITIONALS.  THE COST OF SELLING THE BONDS, BOND COUNSEL FEES AND FINANCIAL ADVISOR FEES.  SO, SHE DIDN'T KNOW IF THE COUNCIL WOULD HAVE $359,000.00 TO START THE EASTSIDE BYPASS.  SHE SAID THE COUNCIL WANTED TO PAY AS YOU GO A LITTLE BIT MORE THAN ISSUING THE 1.7 AT ONE TIME.  THAT IS WHY WE AUTHORIZED MORE  THAN ONE BOND.  WE WOULD ONLY ISSUE WHAT YOU NEED FOR GARNER STREET, TO DO THE INDOT BIDDING.  WHEN YOU ARE GETTING STATE GRANT MONEY AND INDOT IS DOING THE BIDDING, YOU HAVE TO HAVE ALL THE CASH UP FRONT.  THEY WILL NOT BID THE PROJECT UNTIL YOU SHOW YOU HAVE ALL THE CASH.  SO, WHAT WE WERE LOOKING TO DO, ISSUE FOR GARNER STREET NOW, SHOW INDOT THAT YOU HAVE THE AUTHORITY DOWN THE ROAD FOR THE EASTSIDE BYPASS, WHEN THAT BECOMES AVAILABLE, AND ISSUE THOSE BONDS AT THAT TIME.  YOU WON'T BE PAYING INTEREST ON THAT MONEY FOR A YEAR AND A HALF BEFORE THE TIME.  SHE TOLD THE COUNCIL YES, THEY COULD LOWER IT TO $860,000 BUT TO REMEMBER THERE ARE OTHER FEES.  SHE SAID TO BE CAUTION NOT TO LOWER THAT MAXIMUM TO MUCH.  IF WE COME BACK AND THE BIDS COME IN HIGHER, WE WILL HAVE TO GO THROUGH THIS PROCESS ALL OVER.

      ATTORNEY COPENHAVER SAID HE FELT OBLIGATED TO SAY THAT IT IS DANGEROUS TO TIE THIS $293,000. TO THIS ROAD PROJECT.  KEEP IN MIND; THIS IS A ONE TIME DEAL.  WE DIDN'T GET IT BECAUSE OF THE ROAD PROJECT.  IT IS A BLESSING, THIS MONEY.  IT GIVES YOU SOME MONEY THAT YOU CAN PUT INTO THE BANK AND SAVE FOR A RAINY DAY.  PERHAPS THIS RAINY DAY IS THIS ROAD.  WE DON'T KNOW AS A COMMUNITY WHAT EFFECT THE CAPS ARE GOING TO HAVE ON OUR FUTURE.  WHEN WE START TALKING ABOUT THINGS EVERY YEAR THAT WE TALK ABOUT, WE DON'T HAVE THE CASH IN THE BANK AND WHERE ARE WE GOING TO GET THE MONEY TO KEEP THE CITY DOORS OPEN.  THIS GIVES YOU A RARE OPPORTUNITY OF SOME MONEY THAT HAS TO START OUT IN THAT RAINY DAY FUND.  MAKE SURE YOU UNDERSTAND THAT THIS MONEY HAS NO CONNECTION TO THESE ROADS.  THIS MONEY WAS NOT OBTAINED BY THE MAYOR GOING TO INDIANAPOLIS AND ASKING FOR MONEY FOR ROADS.  THIS MONEY IS GOING TO ALL COMMUNITIES AROUND THE STATE. ONCE THIS MONEY IS GONE, IT'S GONE.  THE ONLY WAY MONEY GETS BACK INTO THE RAINY DAY FUND IS IF YOU HAVE EXCESS AND YOU WANT TO PUT UP TO 10% EXCESS BACK INTO IT.  WE HAVE NEVER HAD A RAINY DAY FUND BECAUSE WE HAVE NEVER HAD CASH TO PUT IN THERE. 

      COUNCILMAN REID SAID THE $293,000. THAT WE ARE TALKING ABOUT COMES FROM THE EXCESS ECONOMIC DEVELOPMENT INCOME TAX.  MOST CITIES WHO HAVE AN ECONOMIC DEVELOPMENT HAVE PUT THERE CEDIT MONEY INTO THERE COUNTY ECONOMIC DEVELOPMENT CORPORATION.  HE SAID HE DIDN'T THINK WE SHOULD USE EVERY PENNY, BUT WE DO HAVE THE ABILITY TO USE SOME OF THAT CEDIT MONEY TO HELP PAY FOR TWO WORTHWHILE ECONOMIC DEVELOPMENT PROJECTS.  

COUNCILMAN REID SAID HE WAS GOING TO SWITCH GEARS FOR A MINUTE.  WE ARE ANTICIPATING ABOUT TWO HUNDRED AND FIFTY THOUSAND DOLLARS THIS YEAR IN CCD MONEY.  AFTER WE PAY SOME OF OUR LOANS BACK, ROUND OFF AT ONE HUNDRED THOUSAND DOLLARS WORTH OF CCD MONEY ON HAND.

THAT IS THREE HUNDRED AND FIFTY THOUSAND DOLLARS.  OUR BOND DEBT SERVICE SHEET SHOWS THE CITY TAKING TURNS OF $72,819.00 PER YEAR FROM LRS FOR THE NEXT 15 YEARS.  HE SAID HE THOUGHT BONDING LESS MONEY; WE COULD AS A CITY, PAY CASH FOR ONE OF THESE PROJECTS OR USING THE BOND ON GARNER STREET AND THEN USING SOME OF THIS MONEY OVER THE NEXT TWO TO THREE YEARS, ADDING MORE TO IT, PAY OFF THE EASTSIDE PROJECT WITH MONEY ON HAND.  PAY GARNER STREET WITH BOND MONEY AND USE OUR CCD AND LRS MONEY IN THE RAINY DAY FUND.  HE SAID RIGHT NOW, THE STREET DEPARTMENT IS FUNDED FROM TWO DIFFERENT FUNDS.   HE WAS CONCERNED ABOUT THE FUNDING OF THE DEPARTMENT AND IN THE NEXT COUPLE OF YEARS, ARE WE GOING TO HAVE TO OUT SOURCE THE STREET DEPARTMENT AND HAVE TO START CHARGING CITIZENS FOR CASH?  THAT SEEMED TO BE THE REASONABLE OUT COME FOR HIM OF WHAT WAS TO HAPPEN IF THIS FULL AMOUNT IS BONDED.

      COUNCILMAN KIDD SAID THAT HOWEVER THE MONEY IS GOTTEN, HE FELT THAT GARNER STREET PROJECT WAS THE MOST IMPORTANT AT THIS TIME.

      NORMA DISHMAN SAID IT HASN'T BEEN TO LONG AGO WHEN DISCUSSION WAS ABOUT LAY OFFS.  SHE DIDN'T THINK WE SHOULD DO ANYTHING UNTIL WE COULD PAY FOR IT IN FULL.  SHE SAID THERE ISN'T ANY REASON TO GO TO A BOND.

      COUNCILMAN REID MADE THE MOTION TO AMEND THIS ORDINANCE TO ALLOW THE CITY TO BOND FOR GARNER STREET AND EASTSIDE PROJECT WITH OUR FINANCIAL ADVISOR AND BOND ATTORNEY AND THAT AMOUNT WOULD NOT EXCEED $860,000.00.   COUNCILMAN HAHN: SECOND.     ROLL CALL VOTE: SIX VOTES AYE     ONE VOTE NAY (GOODMAN)    PASSED

AN ORDINANCE OF THE CITY OF NEW CASTLE APPROPRIATING THE PROCEEDS OF THE GENERAL REVENUE BONDS WAS READ BY TITLE ONLY ON SECOND READING BY SANDY YORK.

      PRESIDENT YORK MADE THE MOTION TO AMEND THIS ORDINANCE TO COINCIDE WITH ORDINANCE #3566 AND AMEND THE DOLLAR AMOUNT TO $860,000.00.   COUNCILMAN REID: SECOND.    ROLL CALLVOTE:  SEVEN VOTES AYE.                          AMENDED.

 

MAYOR SMALL ANNOUNCED THAT THIS WAS A PUBLIC HEARING ON ORDINANCE #3567.

AN AMENDED ORDINANCE OF THE CITY OF NEW CASTLE APPROPRIATING THE PROCEEDS OF THE GENERAL REVENUE BONDS WAS READ AS AMENDED BY SANDY YORK.

AN ORDINANCE TO ESTABLISH A NEW CASTLE RAINY DAY FUND PURSUANT TO INDIANA CODE 36-1-8.5-1 WAS READ IN FULL ON FIRST READING BY SANDY YORK.

      PRESIDENT YORK MOVED TO PASS THIS ORDINANCE.  COUNCILMAN HAHN: SECOND

      DISCUSSION: COUNCILMAN REID ASKED UNDER #3, SHOULD THAT BE CHANGED FROM LEGAL AND LEGITIMATE GOVERNMENT SERVICE TO LEGAL AND LEGITIMATE GOVERNMENTAL EXPENDITURES?  TO GIVE THE COUNCIL MORE FLEXIBILITY.

      ATTORNEY COPENHAVER STATED THAT WOULD NOT OFFEND HIM.  HE SAID HE GOT THAT LANGUAGE FROM THE STATE AUDITOR.  HE SAID HE DIDN'T CHANGE THE WORDING BECAUSE THE STATE SENT US THE CHECK.  THIS IS THE SAME LANGUAGE THAT THE COUNTY USED WEDNESDAY NIGHT AND OTHER COMMUNITIES AROUND THE STATE ARE USING.

       ROLL CALL VOTE: SEVEN VOTES AYE.                             PASSED AND ORDERED.

ROLL CALL VOTE: SEVEN VOTES AYE.        PASSED AND ORDERED.

 

COUNCIL REPORTS:

COUNCILMAN HAHN STATED THAT THERE IS A 16% HIGHER RATE OF GRADUATION IN THE SCHOOL SYSTEM FROM BOY AND GIRL SCOUTS.  APPLAUSE WAS GIVEN TO THE GIRL AND BOY SCOUTS OF AMERICA.

     
ATTORNEY COPENHAVER SAID HE RECEIVED A CALL TODAY FROM THE FINANCIAL PEOPLE OF THE YMCA.  HE SAID THEY HAVE A BOND COMING DUE AND NEED TO RENEW IT.  THEY NEED TO LOOK TO GOVERNMENTAL SOURCE AS A CONDUIT.  HE SAID HE TOLD THEM THAT IF THE CITY GOVERNMENT HAD NO OBJECTIONS IN HIS ASSISTING THEM, HE WOULD.

      PRESIDENT YORK MOVED TO APPROVE THE ASSISTING OF ATTORNEY COPENHAVER WITH THE YMCA BOND RENEWAL.  COUNCILMAN KIDD: SECOND.   ROLL CALL VOTE: SEVEN VOTES AYE.      APPROVED.
